What Is DWI Deferred Adjudication?

Understanding Texas House Bill (HB) 3582

In September 2019, the Texas Legislature passed House Bill 3582, allowing first-time DWI offenders to enter a deferred adjudication program instead of being convicted. This means that if you are eligible and successfully complete the program, you will not have a DWI conviction on your record.

Before the passage of this bill, first-time DWI offenders were not able to enter into a deferred adjudication program. They would instead face conviction, which could result in jail time, fines, license suspension, and other consequences.

This new law allows first-time DWI offenders to avoid these severe penalties by completing a probationary period and meeting certain requirements.

Texas DWI Deferred Adjudication Criteria

The DWI deferred adjudication program isn't available to all offenders.

To qualify for the program, you must meet specific criteria, such as:

  • Being a first-time DWI offender with no prior DWI convictions
  • Having a blood alcohol concentration (BAC) of less than 0.15%
  • Not causing any injuries or deaths while driving under the influence
  • Voluntarily agreeing to participate in the program and waive your right to a trial

In addition to these criteria, the judge and prosecutor must also agree to allow you into the program. Typically, those with a clean criminal record showing genuine remorse for their actions are more likely to be accepted for DWI deferred adjudication.

DWI Deferred Adjudication Requirements in Texas

If accepted into the DWI deferred adjudication program, you must complete certain conditions during your probationary period, typically lasting anywhere from six months to two years.

These requirements may include:

  • Attending alcohol education classes
  • Completing community service hours
  • Abstaining from alcohol and drugs
  • Installing an ignition interlock device on your vehicle
  • Reporting to a probation officer
  • Paying fines and court costs

If you successfully complete your probationary period and meet all the requirements, your case will be dismissed, and you will not have a DWI conviction on your record.

However, if you fail to comply with any of the conditions or are arrested for another DWI during this time, you may face conviction and all the penalties that come with it.

The Benefits of DWI Deferred Adjudication

Participating in a DWI deferred adjudication program can have significant benefits, including:

  • Avoiding a permanent criminal record
  • Preserving your driving privileges
  • Lower fines and lower insurance premiums compared to convicted offenders
  • Ability to maintain employment and avoid negative impact on career opportunities
  • Keeping your reputation intact and avoiding the public stigma associated with a DWI conviction

It is important to note that while the program can offer these benefits, it is not an easy way out. The requirements can be strict, and failure to comply can result in severe consequences.

Legal representation from an experienced attorney at the Law Offices of David White ensures you've got someone on your side to guide you through the process and increase your chances of a successful outcome.

Why Do I Need A DWI Deferred Adjudication Lawyer in Texas?

Texas's strict DWI laws are matched only by the complicated legal process of defending a DWI charge. This is why having an experienced and knowledgeable DWI lawyer on your side is crucial, especially if you are considering entering a deferred adjudication program.

Without the help of an experienced lawyer, DWI offenders may find themselves:

  • Being denied entry into the program due to lack of knowledge about eligibility criteria or inability to present a strong case
  • Facing harsher penalties due to failure to meet requirements during the probationary period
  • Stuck with a permanent criminal record that can have a detrimental impact on their future

Considering that the consequences of a first-time DWI offense include up to $2,000 in fines, a maximum of 180 days in prison, and possible permanent suspension of your driver's license, seeking legal representation is a wise investment that can save you money and protect your future.
